PROTECTION OF PERSONAL DATA
ENLIGHTENMENT TEXT FOR THE GUEST

This disclosure is made by Ela Hospitality Turizm ve Otelcilik A.Ş. (Former Company Title: Aktay Otel İşletmeleri A.Ş.) (“Ela Hotel”), in its capacity as data controller, within the scope of the data controller’s obligation to inform as regulated under Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK”).
Processing of Your Personal Data, Purpose, and Legal Basis

1. Personal and Special Categories of Personal Data Processed Due to Accommodation and Services Received
  - a. Identity information (full name, date of birth, Turkish ID number, passport number), Contact Information (address, e-mail address, phone number), Accommodation Information (room number), Customer Transaction Data (call center and hotel solution center records, request and complaint details, payment information, invoice information), Physical Space Security Data (hotel entry/exit records of guests, security camera footage, vehicle license plates), information you share through the use of Ela Holiday Assistant, Transaction Security Data (log and traffic information when using the Ela Hotel Wi-Fi network), as well as information regarding individuals accompanying you during your stay are processed by Ela Hotel.
  - These personal data are processed mainly for the purposes of carrying out accommodation transactions within the scope of the service agreement between us and our customers, providing support during and after the service, improving service quality, ensuring communication, managing customer relationship processes, offering you personalized services, handling your accommodation insurance transactions, conducting accounting, finance and legal processes, and enabling your connection to the Wi-Fi network. Such personal data are processed pursuant to Article 5/2 of the KVKK on the legal grounds of being explicitly stipulated by law (Tax Procedure Law, Identity Notification Law, Consumer Protection Law, Law No. 5651 and other relevant legislation), being necessary for the establishment and performance of a contract, being mandatory for the establishment, exercise or protection of a right, and being necessary for the legitimate interests of the data controller.
  - b. Audio Records (voice recordings of conversations at the reception, call center, and hotel solution center) are processed for the purposes of ensuring customer satisfaction and quality standards and improving services, on the legal grounds set forth in Article 5/2 of the KVKK, namely the necessity of processing for the establishment and performance of a contract, for the establishment, exercise, or protection of a right, and for the legitimate interests of the data controller.
    c. In the event that you have any allergies, your special category personal data regarding your allergy information, obtained through the allergy card you present in dining areas and the information you share via the Ela Holiday Assistant, are processed for the purpose of protecting you and providing better service. Such data are processed pursuant to Article 6/3 of the KVKK on the legal grounds of being made public by the data subject and used in accordance with the intent of disclosure, as well as being necessary to protect the physical integrity of a person who is unable to declare consent due to actual impossibility.
2. Personal Data Processed for the Purpose of Sending Commercial Communications: Your identity information (name, surname) and contact information (phone number, e-mail addresses), your choices and preferences regarding your accommodation and the services you receive, as well as the personal data you provide through the Ela Holiday Assistant, will be processed based on your explicit consent for the purposes of informing you about our campaigns, products, and services, and for sending commercial communications via SMS, calls, and e-mails.
3. Personal Data Processed Through the Ela Excellence Hotel Mobile Application: During your stay, we also provide our valued guests with hotel and accommodation-related services via the mobile application. Your personal data collected in the Ela Excellence Hotel Application for the purposes of benefiting from restaurants, accommodation-related reservations, and the service groups listed under the Services category in the Application are processed pursuant to Article 5/2 of the KVKK on the legal grounds of being necessary for the establishment or performance of a contract or for the establishment of a right.
4. Personal Data Regarding Social Media Posts: Public photos and videos you share on social media in relation to your stay at Ela Hotel may be published on Ela Hotel’s social media accounts if you tag the Ela Hotel accounts, based on the legal ground of “being made public by the data subject.”
5. Visual and Audio Records Obtained at Events and Organizations: Photo and video recordings taken in areas open to hotel guests or the general public, or during events and organizations held at Ela Hotel, are processed for sharing via social media and digital channels. In the event that you choose to be present in such areas where photo and video recordings are taken, your personal data are processed and shared pursuant to Article 5/2 of the KVKK on the legal ground of “being made public by the data subject.
  
  5.1. Method of Collecting Your Personal Data
  1. Your personal data are processed through automatic and non-automatic means via the forms you fill out at the reception, digital forms you complete on websites, requests and communications made during your stay at the hotel, online applications, cookies, digital forms, digital marketing technology tools, call center, mobile application, e-mails, search engines, third-party websites sharing data with us based on your consent, social media channels, and in physical environments through agencies, printed forms, our dealers, direct communication by our sales and marketing representatives, our agencies, travel companies, tour operators, membership forms, targeting, profiling, online behavioral advertising methods, and our business partners. The common areas of our hotel are monitored by a closed-circuit security camera system.

Transfer of Your Personal Data, Purpose, and Legal Basis
1. Your personal data are shared, limited solely to this purpose, with the “Suppliers” and “Business Partners” with whom we are in a business relationship and from whom we receive services, pursuant to Article 5/2 of the KVKK on the legal grounds of the necessity of data processing for the legitimate interests of the data controller, the establishment or performance of a contract, the establishment, exercise, or protection of a right, and the fulfillment of a legal obligation, for the performance of contracts concluded for obtaining necessary external services related to our activities. For example, in the event of a legal dispute, your personal data may be shared with the Lawyers from whom we receive services; with the Certified Public Accountants due to financial obligations; with Auditors in cases of audits; with Travel Agencies and Companies through which you make reservations and purchases as part of the necessary processes for the performance of the contract; with Banks, if required, for payment transactions related to your accommodation; with Suppliers and Business Partners in cases where external services are required concerning your accommodation and our services; and with our Group Companies, Affiliates, and Subsidiaries, including but not limited to Özak Global Holding A.Ş., Özak Gayrimenkul Yatırım Ortaklığı A.Ş., and Kamer İnşaat Ticaret ve San. A.Ş., in cases where certain services are provided centrally, limited to the purposes necessary for the execution of the relevant transaction.
2. The identity and arrival–departure records of hotel guests are transferred to the General Law Enforcement Authorities and the State Statistical Institute pursuant to Article 2 of the Identity Notification Law, based on the legal ground of being expressly stipulated by law and fulfilling Ela Hotel’s legal obligations.
3. Your personal data processed for the purpose of sending commercial communications will, based on your explicit consent, be shared with our main shareholders, affiliates, group and subsidiary companies, including but not limited to Özak Global Holding A.Ş., Özak GYO A.Ş., Akyön Tesis Yönetim Hizmetleri A.Ş., Kamer İnşaat Ticaret ve San. A.Ş., ÖYZ Joint Venture, as well as with CRM, SMS and e-mail service providers, call service providers, domestic and foreign software, server, agency and service providers and data processors offering measurement, targeting, and profiling support, and İleti Yönetim Sistemi Inc. for the purpose of sending you commercial electronic communications regarding other services and products.
4. Your personal data are transferred to “Authorized Public Institutions and Organizations” (e.g., Courts, Police, Law Enforcement Authorities, Consumer Arbitration Committees) pursuant to Article 5/2 of the KVKK, on the legal grounds of fulfilling Ela Hotel’s obligations to share information and documents arising from legislation and, if necessary, to exercise its rights, being mandatory for the establishment, exercise, or protection of a right, and fulfilling a legal obligation.
5. Your health data, in cases of emergency or mandatory health needs, are transferred, if necessary, to “Authorized Public Institutions and Organizations” (State Hospitals, Police) pursuant to Article 6/3 of the KVKK, on the legal ground of being necessary to protect the physical integrity of a person who is unable to declare consent due to actual impossibility.
Your Rights
- To the extent your data are processed by Ela Hotel, you have the rights set forth in Article 11 of the Law on the Protection of Personal Data No. 6698 regarding your personal data.
- In accordance with the “Communiqué on the Principles and Procedures for the Application to the Data Controller,” you may submit your requests under Article 11 of the Law, which regulates the rights of the data subject, in writing or by using your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address previously provided by you and registered in our system.
